No ICE in Marin!

ICE and the Trump Administration pose an existential threat to our immigrant neighbors and to our civil liberties.

We are here to organize and fight back at the local level by pressuring our Marin County elected officials to stop all cooperation with federal immigration authorities and to prepare for the possibility of a large-scale ICE mobilization in Marin.

We are demanding that the Marin County Board of Supervisors adopt an “ICE-Free Marin” ordinance that would legally prohibit ICE from using county property or resources to conduct its operations, ensure prompt and transparent reporting on local ICE activities, and require all law enforcement operating within the county to publicly identify themselves.

Numerous other Bay Area counties and cities have already passed similar policies to protect their immigrant communities. Marin has a moral obligation to do the same. We have already provided the board with a draft ordinance based on the strongest provisions already adopted in nearby jurisdictions. 

The ordinance has three major components:

  1. Bar the use of County property, information, resources, and personnel for federal immigration enforcement, except to the extent required by a valid judicial warrant or court order. (This includes securing the booking logs and withdrawing from SCAAP).

  2. Establish an effective reporting out system for County departments to ensure the Board of Supervisors and the public receive timely and accurate information regarding immigration enforcement activity in our community.

  3. Require visible identification and forbid the use of facial coverings by law enforcement operating in the County, in order to promote public safety and law enforcement accountability.

About No ICE in Marin

No ICE in Marin is a grassroots campaign organized by a coalition of 16 (and counting) local community organizations united to end any and all cooperation between the County of Marin and federal immigration authorities.

Since last fall, we have recruited over 5,000 Marin residents to sign petitions and mobilized hundreds more to give public comment at Board of Supervisors meetings, calling on the Marin County Sheriff's Office and the Marin County Board of Supervisors to end their shameful cooperation with Immigration and Customs Enforcement (ICE). 

Local pressure is working. In February, the county announced that it would drop SCAAP funding from the next two-year budget. SCAAP stands for State Criminal Alien Assistance Program, a federal program whereby our sheriff has sold the personal information of undocumented immigrants in his custody to federal law enforcement agencies, including ICE, for roughly $1,000 per person reported.

But there is still more work to be done. Neither the sheriff nor the board of supervisors has committed to fully and permanently withdraw from SCAAP, and the sheriff’s office continues to voluntarily cooperate with ICE, exploiting loopholes in California’s state sanctuary law, the California Values Act (SB 54).

Furthermore, Marin is not prepared for a large-scale ICE mobilization targeting the San Francisco Bay Area, the way Minneapolis, Chicago, and Los Angeles have all been targeted. That is why we’re now focused on getting the Marin County Board of Supervisors to adopt an “ICE-Free Marin” ordinance that would starve federal immigration agencies of local resources that could otherwise be used to occupy and terrorize our community.

How does the Sheriff Cooperate with ICE?

The Marin County Sheriff’s Office has cooperated with ICE for years, despite California’s sanctuary state status and overwhelming local opposition. With ICE and DHS ramping up their cruel and lawless violence against immigrant communities and peaceful protestors across the country, it's essential that we do all that we can to stop any and all collaboration between our sheriff and federal immigration authorities. Here’s how our sheriff cooperates with ICE:

SCAAP: Reporting our undocumented neighbors to ICE for $1,000 apiece. The Marin County Sheriff’s Office has, until very recently, participated in SCAAP, the State Criminal Alien Assistance Program. SCAAP is a federal program that provides a roughly $1,000 bounty to local law enforcement agencies for reporting information on undocumented immigrants in their custody. Over the past three years, the Marin County Sheriff’s Office has received over $1.2 million for reporting over 1,000 immigrants to ICE and DHS. As a result of our local community pressure, the county has announced that it will be temporarily dropping SCAAP funding from the next two-year budget. But neither the sheriff nor the board of supervisors has committed to fully and permanently withdraw from SCAAP.

Our Demand: Fully and permanently withdraw from SCAAP.

Booking Logs: Publishing personal information that ICE can use to detain immigrants. The sheriff openly publicizes its booking logs, which contain the personal information and release dates of people in their custody. This allows ICE to wait outside the county jail and detain those they suspect of being undocumented.

Our Demand: Stop publishing booking logs and instead implement a searchable system like those used by San Francisco, San Mateo, and Santa Cruz counties.

Direct Collaboration: Complying with ICE requests for reports on undocumented immigrants. Our sheriff exploits a loophole in state sanctuary law, the CA Values Act (SB54), enabling him to directly report undocumented immigrants in the sheriff’s custody to ICE. Last year, the Marin County Sheriff’s Office voluntarily complied with 23 ICE requests. 

Our Demand: Refuse all ICE requests without a judicial warrant.
